Games, LLC (“Eek Games”, “we”, “us”, or “our”) websites, games, forums, or services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

Scope

These Terms apply to all Eek! Games, LLC websites and services, including but not limited to all subdomains of eekgames.com, eekllc.com, housepartygame.com, officepartygame.com, and eekllc.com, as well as the games “House Party” and “Office Party.” Certain services, such as our Shopify store (store.eekllc.com), may have additional or different terms.

Eligibility

Our Services are intended solely for adults 18 years of age or older. By using our Services, you represent that you are at least 18 years old. We are not liable for any false statements regarding age or for unauthorized use by individuals under 18.
You must be at least 18 years of age to register for or use our Services, or to upload user-generated content such as custom stories or character designs.
By using our Services, you represent and warrant that you meet all eligibility requirements and that all information you provide is accurate and truthful.

System Requirements and Availability

We do not guarantee that our Services will be compatible with your device, uninterrupted, or error-free. We reserve the right to modify, suspend, or discontinue any part of our Services at any time.

Reservation of Rights to Refuse Service

We reserve the right to refuse service to anyone, for any reason, at any time, to the extent permitted by law.

Account Registration and Security

You may need to create an account to access certain features of our Services. You are responsible for maintaining the security of your account and password.
You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms or for any other reason.

User Conduct

You agree to use our Services in compliance with all applicable laws and regulations.
You agree not to engage in unlawful, abusive, harassing, hateful, or otherwise objectionable behavior while using our Services.
You must not upload, post, or share any content that is defamatory, obscene, infringing, or otherwise violates the rights of others.

User-Generated Content

Our Services may allow you to create, upload, or share content (“User-Generated Content” or “UGC”), including but not limited to:

Stories created using the House Party Custom Story Creator and the upcoming Office Party Custom Story Creator
Character designs and customizations using the character customization and design sharing tools for House Party and Office Party
Forum posts, discussions, and other materials shared through our sites and services

By uploading, sharing, or otherwise submitting User-Generated Content through our Services, you agree to the following:

You retain copyright to your original creative contributions (such as unique text, storylines, or custom character designs) created using our tools. However, all software, game assets, characters, artwork, and intellectual property provided by Eek! Games, LLC (“Eek IP”) remain the exclusive property of Eek! Games, LLC.
Your User-Generated Content is considered derivative of and incorporates Eek IP. Any rights you may have in your original contributions are subject and subordinate to the rights of Eek! Games, LLC in the Eek IP.
By uploading or sharing content via our Services, you grant Eek! Games, LLC a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, adapt, and distribute your content as necessary to operate and promote our Services.
You may not use, reproduce, distribute, or otherwise exploit your User-Generated Content outside of our Services without our express written permission.
You are solely responsible for the content you create, upload, or share, and for ensuring that your content complies with these Terms and all applicable laws.

Custom Story and Character Design Upload Terms

You must be over the age of 18 to upload custom stories or character designs.
All characters depicted in your custom stories or character designs must be portrayed as being above the age of 18.
Custom stories and character designs may explore morally ambiguous themes, but may not contain hate speech or be hateful in nature.
Your custom stories and character designs must comply with the legal parameters of your country’s media regulation standards.
Your content must not include trademarked materials, images, or names, unless you have obtained all necessary rights and permissions.
Eek! Games, LLC reserves the right to remove any story or character design from our service that, in our sole discretion, is unlawful, hateful, malicious, abusive, harassing, exploitative, pedophilic, or otherwise violates any applicable law or these Terms. We reserve the right to remove content for any other reason we deem necessary.

Content that is found to violate these standards may be removed without notice, and accounts responsible for repeated or severe violations may be suspended or terminated.

Community Guidelines

Your use of our Services is subject to compliance with any Community Guidelines or similar policies that we may publish or update from time to time. These guidelines, if and when published, are incorporated by reference into these Terms. We reserve the right to update or create Community Guidelines as needed, and your continued use of the Services constitutes acceptance of any such guidelines.

Content Moderation and Reporting

Eek! Games, LLC reserves the right, but is not obligated, to monitor, review, or remove any User-Generated Content at any time and for any reason. If you encounter content that you believe violates these Terms, please report it to us at info@eekllc.com.

Copyright Infringement and DMCA Policy

If you believe that your intellectual property rights have been infringed by content uploaded to our Services, please notify us at info@eekllc.com with all relevant information. Eek! Games, LLC will respond to valid notices and remove infringing content as required by law.

Third-Party Services and Content

Our Services may contain links to or integrate with third-party websites, platforms, or services that are not owned or controlled by Eek! Games, LLC. We do not endorse or assume any responsibility for any third-party sites, services, or content. Your use of any third-party service is at your own risk and subject to their own terms and policies.

Virtual Goods and Currency

Any virtual currency, items, or unlockable content obtained through our Services are licensed, not sold, to you. They have no real-world value, are non-transferable, and may not be redeemed for cash. We reserve the right to modify, suspend, or discontinue virtual goods and currency at any time without notice or liability.

Beta Features and Updates

We may offer access to beta or pre-release features. These features may be changed, discontinued, or may not become part of the final product. Use of beta features is at your own risk.

Export Control

You may not use or access our Services if you are located in a country embargoed by the United States or are on the U.S. Treasury Department’s list of Specially Designated Nationals. You agree to comply with all applicable export laws and regulations.

Intellectual Property

All content provided by Eek! Games, LLC, including but not limited to games, website content, graphics, logos, and trademarks, is the property of Eek! Games, LLC or its licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute our content without our express permission.

Eek! Games, LLC reserves all rights not expressly granted in these Terms.

Feedback

By submitting feedback, suggestions, or bug reports regarding our Services, you grant Eek! Games, LLC the right to use such feedback for any purpose without compensation or attribution to you.

Termination

We reserve the right to suspend or terminate your access to our Services, or remove any content you have posted, at any time and for any reason, including for violation of these Terms.

Disclaimer of Warranties

Our Services are provided “as is” and “as available,” without warranties of any kind, either express or implied. Eek! Games, LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Eek! Games, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services.

Indemnification

You agree to indemnify, defend, and hold harmless Eek! Games, LLC, its affiliates, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, or expenses arising from your use of the Services or your violation of these Terms.

Dispute Resolution

Any dispute or claim arising out of or relating to these Terms or your use of our Services will be resolved by binding arbitration in Oregon, USA, except as otherwise provided by applicable law.

Class Action Waiver

You agree that any disputes with Eek! Games, LLC will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

Eek! Games, LLC may assign or transfer its rights and obligations under these Terms at any time. You may not assign your rights or obligations without our prior written consent.

Survival

All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, intellectual property, indemnification, limitation of liability, and governing law.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or guidelines posted on our Services, constitute the entire agreement between you and Eek! Games, LLC regarding your use of the Services.

Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated via our website or by email. Continued use of our Services after such changes constitutes your acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of law provisions.
